Terms of Service

1. About Us

This website is operated by The Aloua Family Partnership Ltd trading as Aloua Vision & Print. Throughout these terms, “AVP”, “we”, “us” and “our” refer to that company.

These terms apply when you use our website or purchase products or services from us. Please read them alongside our Shipping Policy, Returns & Refunds Policy and Privacy Policy.

Our online store is hosted by Shopify, which provides the e-commerce platform we use to sell our products and services.

2. Your Consumer Rights

Nothing in these terms excludes or limits your rights or our obligations under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable consumer law.

If any provision conflicts with rights that cannot legally be excluded, those rights take priority.

3. Using Our Website

You must use our website lawfully. You must not interfere with its security or operation, introduce malicious software, misuse another person’s information, submit fraudulent orders or infringe intellectual property rights.

Please provide accurate contact, billing and delivery information, and keep your account details secure.

We may restrict access where reasonably necessary to address fraud, unlawful activity, security threats or serious misuse. This does not remove our obligations relating to existing orders.

4. Products and Descriptions

We aim to provide accurate product descriptions, images, size charts and pricing.

Colours can appear differently between screens and the finished product. Minor variations may occur in printing and manufacturing, but products must still meet applicable quality requirements and match their description.

Please check the size chart and product information before ordering. Contact us if you need help choosing an item.

If a product becomes unavailable, we will contact you to discuss an alternative or refund. We will not substitute a materially different product without your agreement.

5. Made-to-Order Products

Most AVP products are made to order.

Made to order: Please allow up to 14 working days for your order to be dispatched.

Working days are Monday to Friday, excluding New Zealand public holidays. This timeframe covers production, preparation and dispatch. Courier delivery time is additional.

If we become aware of a significant delay affecting your order, we will contact you with an update and discuss the available options. A delay does not remove any rights you have under applicable consumer law.

A different timeframe for a custom project or bulk order must be clearly agreed with you before that work proceeds.

6. Orders, Prices and Payment

Please review your order, selected options, delivery details and total charges before completing checkout.

Prices and promotions may change for future purchases. We will not increase the agreed price of an existing order without your agreement.

Payment must be made using an available checkout method, unless we have agreed to different payment arrangements in writing.

If we identify an error in pricing, product information or availability that affects your order, we will contact you promptly to explain it and discuss a resolution. We will not automatically charge an additional amount without your permission. Any cancellation will be handled in accordance with applicable law, and amounts paid for items we do not supply will be refunded.

We may decline orders on reasonable grounds, such as suspected fraud, inability to supply or an unlawful request. If this affects an order you have already paid for, we will notify you and refund any amount due for products or services not supplied.

7. Changes and Cancellations Requested by You

Contact us as soon as possible if you need to change or cancel an order.

Because most products are made to order, we cannot guarantee that a change or change-of-mind cancellation will be possible once production has started. We will explain what is possible and obtain your agreement before carrying out additional work that incurs a charge.

This does not limit cancellation or other remedies available under applicable consumer law.

8. Custom Printing, Artwork and Personalisation

Please check names, spelling, sizes, colours and other personalised details carefully.

Where we provide a proof for approval, please review it before approving production. We will produce the work according to the agreed specifications and approved proof. If we make an error or the finished work does not match what was agreed, your rights to a remedy remain.

You must own, or have permission to use, any artwork, logos, photographs or other material you ask us to reproduce.

You give us permission to use that material to prepare and fulfil your order, including sharing it with service providers where necessary for that purpose. Supplying material does not transfer ownership of it to us.

We will seek your permission before using your private artwork, photographs or personalised order details in our advertising or portfolio.

We may decline material that is unlawful, infringes others’ rights or contains abusive or discriminatory content.

9. Shipping and Delivery

Available delivery options and charges are shown at checkout or agreed as part of a custom quote.

Please provide a complete and accurate delivery address. Contact us promptly if you notice an error. Address changes may not be possible after dispatch.

Courier delivery estimates are separate from our production timeframe. If an order is delayed, lost or damaged in transit, please contact us so we can investigate and meet our obligations under applicable consumer law.

10. Returns, Faults and Refunds

Our Returns & Refunds Policy explains how to contact us about faulty, damaged or incorrect products and how claims are assessed.

We do not offer returns or exchanges simply for a change of mind or an incorrectly selected size or colour where we supplied the order correctly and our product information was accurate.

Made-to-order, personalised and sale products remain subject to applicable consumer protections. Please contact us if a product is faulty, does not match its description or otherwise fails to meet those protections.

11. Intellectual Property, AVP Original Designs and Reviews

Website content, branding, photographs and designs belong to AVP or their respective owners or licensors.

Copyright in AVP original designs owned by The Aloua Family Partnership Ltd trading as Aloua Vision & Print is reserved.

Unless permitted by law, no person or business may copy, reproduce, reprint, distribute or sell unauthorised copies of these designs, or use them to produce clothing, merchandise, transfers, digital files or other products, without our prior written permission.

Purchasing an AVP product does not transfer ownership of the design or give permission to reproduce it. This includes supplying a copy of the design to another printer, manufacturer or business for reproduction.

These restrictions concern the copying and use of our designs. They do not prohibit lawful resale of a genuine AVP product.

Customer-supplied artwork and third-party material remain the property of their respective owners. We claim rights only in material we own or are authorised to protect.

Reviews and Website Use

You may browse our website and share links to our products.

If you submit a review for public display, you permit us to display it in connection with the relevant product or service. We will not edit a review in a way that misrepresents your experience.

Reviews must reflect genuine experiences and must not contain unlawful content, another person’s private information or material that infringes others’ rights.

Private messages and artwork supplied for an order are not treated as public reviews.

12. Privacy and Third-Party Services

We handle personal information in accordance with our Privacy Policy and applicable privacy law.

Our store is hosted by Shopify, which processes personal information when you visit or purchase from our store.

We use Shopify Network Intelligence to support enhanced services, including personalisation, advertising and fraud prevention. These services use information from interactions with our store, other merchants and Shopify.

To provide these services, personal information is shared with Shopify and relevant third parties that may be located outside New Zealand. Our Privacy Policy explains this processing and your choices. Further information is available in Shopify’s Consumer Privacy Policy and Shopify’s Privacy Portal.

Our website may include links to external websites or access to third-party services. Those providers may have their own terms and privacy policies, which you should review when using them.

Using a third-party platform, payment provider or courier does not remove our responsibilities to you for products or services we supply.

13. Website Availability and Responsibility

We aim to keep our website available and functioning correctly, but access may occasionally be interrupted by maintenance or technical problems.

If an interruption affects your order or payment, please contact us.

We remain responsible for our products, services and conduct as required by applicable law. These terms do not impose a blanket exclusion of liability for faults, misleading information or other matters for which we are legally responsible.

14. Changes to These Terms

We may update these terms from time to time. Updated terms will be published on this page and apply to future orders.

The version in place when you order will continue to apply to that order unless we agree otherwise with you or a change is required by law.

Changes to these terms do not remove rights relating to earlier purchases.

15. Governing Law and Resolving Concerns

These terms are governed by New Zealand law. Any mandatory consumer protections that apply to your purchase remain available.

Please contact us first if you have a concern so we can try to resolve it. Nothing in these terms prevents you from seeking assistance from an appropriate regulator, disputes body or court.

If part of these terms is found to be unenforceable, the remaining provisions continue to apply to the extent permitted by law.
